Asbestos legislation is lengthy and can be complex.
The legislation puts the responsibility for managing the asbestos safely with the duty holder who is defined as “every person who has, by virtue of a contract or tenancy, an obligation of any extent in relation to the maintenance or repair of non-domestic premises or any means of access or egress to or from those premises”
Many businesses wrongly assume that their responsibility extends only to ensure their buildings have an asbestos survey. Breach of the regulations can lead to HSE prosecution.
